5.TheCommissionshallby11June2010publishguidelinesfordeterminationofcontributionsfromthere-suspensionofpar-ticulatesfollowingwinter-sandingor-saltingofroads.

Article22

Postponementofattainmentdeadlinesandexemptionfromtheobligationtoapplycertainlimitvalues

1.Where,inagivenzoneoragglomeration,conformitywiththelimitvaluesfornitrogendioxideorbenzenecannotbeachievedbythedeadlinesspecifiedinAnnexXI,aMemberStatemaypostponethosedeadlinesbyamaximumoffiveyearsforthatparticularzoneoragglomeration,onconditionthatanairqualityplanisestablishedinaccordancewithArticle23forthezoneoragglomerationtowhichthepostponementwouldapply;suchairqualityplanshallbesupplementedbytheinformationlistedinSectionBofAnnexXVrelatedtothepollutantscon-cernedandshalldemonstratehowconformitywillbeachievedwiththelimitvaluesbeforethenewdeadline.

2.Where,inagivenzoneoragglomeration,conformitywiththelimitvaluesforPMofsite-specific10asspecifiedinAnnexXIcannotbeachievedbecausedispersioncharacteristics,adverseclimaticconditionsortransboundarycontributions,aMemberStateshallbeexemptfromtheobligationtoapplythoselimitval-uesuntil11June2011providedthattheconditionslaiddowninparagraph1arefulfilledandthattheMemberStateshowsthatallappropriatemeasureshavebeentakenatnational,regionalandlocalleveltomeetthedeadlines.

3.WhereaMemberStateappliesparagraphs1or2,itshallensurethatthelimitvalueforeachpollutantisnotexceededbymorethanthemaximummarginoftolerancespecifiedinAnnexXIforeachofthepollutantsconcerned.

4.MemberStatesshallnotifytheCommissionwhere,intheirview,paragraphs1or2areapplicable,andshallcommunicatetheairqualityplanreferredtoinparagraph1includingallrel-evantinformationnecessaryfortheCommissiontoassesswhetherment,ornottherelevantconditionsaresatisfied.ontheCommissionshalltakeintoaccountestimatedInitsassess-effectsfuture,ambientwellofairqualityintheMemberStates,atpresentandinthemunityasestimatedmeasuresposedbymeasureseffectsthathavebeentakenbytheMemberStatesastheCommission.

Airqualityplans

1.Where,ingivenzonesoragglomerations,thelevelsofpol-lutantsinambientairexceedanylimitvalueortargetvalue,plusanyrelevantmarginoftoleranceineachcase,MemberStatesshallensurethatairqualityplansareestablishedforthosezonesandagglomerationsinordertoachievetherelatedlimitvalueortar-getvaluespecifiedinAnnexesXIandXIV.

Intheeventofexceedancesofthoselimitvaluesforwhichtheattainmentdeadlineisalreadyexpired,theairqualityplansshallsetoutappropriatemeasures,sothattheexceedanceperiodcanbekeptasshortaspossible.Theairqualityplansmayaddition-allyincludespecificmeasuresaimingattheprotectionofsensi-tivepopulationgroups,includingchildren.
