MemberStatesshouldlaydownrulesonpenaltiesappli-cabletoinfringementsoftheprovisionsofthisDirectiveandensurethattheyareimplemented.Thepenaltiesshouldbeeffective,proportionateanddissuasive.

CertainprovisionsoftheactsrepealedbythisDirectiveshouldremaininforceinordertoensurethecontinuanceofexistingairqualitylimitsfornitrogendioxideuntiltheyarereplacedfrom1January2010,thecontinuanceofairqualityreportingprovisionsuntilnewimplementingmea-suresareadopted,andthecontinuanceofobligationsrelat-ingtothepreliminaryassessmentsofairqualityrequiredunderDirective2004/107/EC.

ThisDirectiverespectsthefundamentalrightsandobservestheprinciplesrecognisedinparticularbytheCharterofFundamentalRightsoftheEuropeanUnion.Inparticular,thisDirectiveseekstopromotetheintegrationintothepoliciesoftheUnionofahighlevelofenvironmentalpro-tectionandtheimprovementofthequalityoftheenviron-mentinaccordancewiththeprincipleofsustainabledevelopmentaslaiddowninArticle37oftheCharterofFundamentalRightsoftheEuropeanUnion.

ThemeasuresnecessaryfortheimplementationofthisDirectiveshouldbeadoptedinaccordancewithCouncilDecision1999/468/ECof28June1999layingdowntheproceduresfortheexerciseofimplementingpowerscon-ferredontheCommission(2).

TheCommissionshouldbeempoweredtoamendAnnexesItoVI,AnnexesVIIItoXandAnnexXV.Sincethosemeasuresareofgeneralscopeandaredesignedtoamendnon-essentialelementsofthisDirective,theymustbeadoptedinaccordancewiththeregulatoryprocedurewithscrutinyprovidedforinArticle5aofDecision1999/468/EC.
